DailyCalorie Terms of Use

These terms govern your use of DailyCalorie (“the app”). By using the app or subscribing to DailyCalorie Pro, you agree to them. This is the end user license agreement for the app; it applies in place of Apple’s standard licensed application end user license agreement.

Not medical advice. DailyCalorie estimates calories and nutrients so you can keep a record. It is not a medical device, it does not diagnose or treat anything, and nothing in it is a substitute for advice from a qualified clinician. If you have a medical condition, are pregnant, or are under 18, talk to a professional before changing how you eat.

1. What the app does

DailyCalorie logs meals, exercise and weight against a daily calorie window, recognises food from photos, keeps a personal food library, and charts weight against a plan you set. Photo recognition returns an estimate produced by a vision model; the dish, portion and macronutrient split can be wrong in either direction, and you are expected to correct anything that matters to you.

2. Your licence

You get a personal, non-transferable licence to use the app on Apple devices you own or control, under the Usage Rules of the App Store Terms of Service. You may not resell it, rent it out, reverse engineer it, or use it to build a competing service.

3. Free tier

Without a subscription you get three photo recognitions in total, and all of the core logging: the window, meals, exercise and weight, with full history, trends and the month calendar. Manual entry is unlimited. These limits may change between versions; the app’s own comparison screen reflects the version you are running.

4. DailyCalorie Pro

Pro is the only paid item in the app. It adds unlimited photo recognition, per-meal protein/carb/fat targets, a custom goal weight, target date, weekly pace and activity level, and CSV export.

Pro is offered as a monthly or a yearly auto-renewing subscription with identical benefits. Both are billed through your Apple Account. A subscription renews automatically unless auto-renew is switched off at least 24 hours before the current period ends; the renewal is charged within the 24 hours before the period ends.

The yearly plan includes a 7-day free trial on first purchase. Cancel during the trial and nothing is charged; if you do not cancel at least 24 hours before it ends, it converts to a paid subscription. Trial eligibility is determined by the App Store and is normally available once per Apple Account.

Prices, trials, taxes and availability vary by region, and the price that applies to you is shown on the subscription screen before you confirm. You can manage or cancel a subscription at any time in your Apple Account settings. After reinstalling or switching device, Restore purchases on the subscription screen reconnects an active subscription to the same Apple Account. These subscriptions are not family shareable.

Cancelling never deletes your records. You return to the free limits, and everything you logged is still there if you subscribe again.

5. Your content

The photos you submit for recognition, and the entries, weights and notes you record, are yours and remain your responsibility. Do not submit content you have no right to use. How this data is handled is described in the Privacy Policy.

6. Availability

The app is provided as is. Features may change, be interrupted, or be discontinued. Photo recognition depends on a third-party vision service and on your network, and may be unavailable at times. iCloud sync depends on your own Apple Account and iCloud storage.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for lost data, for health or weight outcomes that differ from what you expected, or for indirect or consequential loss arising from your use of the app. Your device is the authoritative copy of your records; export to CSV or enable iCloud sync before changing device.

8. Apple

Apple is not a party to these terms and has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Purchases made through the App Store are subject to Apple’s purchase, refund and subscription rules; request refunds at reportaproblem.apple.com.

9. Changes

These terms may be updated as the app changes. The current version is always the one published at this address, which is the address referenced from the App Store product page.
